AHShaikh.com sells and distributes various products and services directly to the end users through direct selling. It adheres to all the laws while carrying out this business and reiterates its stand not to compromise on any statutory as well as legal guidelines.

AHShaikh.com is engaged in establishing a consumer base through a network of its consumers itself using the word of mouth publicity, which will buy its wide range of products. This Consumer Network is referred to as AHShaikh.com Family. One has to pay Rs. 7200/- to become a member of AHShaikh.com Family.

AHShaikh.com Family members can choose to become an Independent Distributor only by choosing specific amount of AHShaikh.com products. Commissions are paid to a participating consumer by the concerned MLM companies and not from AHShaikh.com purely on purchase of products and not merely referring more and more customers.

The Filling up of Application/Proposal Form is an invitation to participate in the Business Plan of the company. The Applicant by filling up the form along with the terms and conditions and also by making the required payment as applicable gives an offer to the company. The acceptance of the applicants offer by the company will constitute a legal contract that is binding on either party. This contract is between the applicant (herein after referred to as IBD (Independent Business Distributor) and www.AHShaikh.com. (hereinafter referred to as Company).
 
Only if the applicant agrees to adhere to and abide by the terms and conditions mentioned here under and in the web site named www.ahshaikh.com. He/She shall become a IBD on payment of the prescribed fees to the company by way of a crossed Demand Draft/Pay Order, Payable at Mumbai/Online EFT (Electronic Fund Transfer).
 
The IBD should be minimum 18 years of age and shall be competent to enter into contract as provided in the ‘Indian Contract Act’.
 
If the applicant is a Proprietorship/Partnership Firm/Private Limited Company/Limited Company, then the applicant has to provide all documents Like Board Resolution, Partnership Deed/MOU/ROC or any other documents as deemed necessary.
 
While placing orders for any of the products available with the company, he/she will have to pay the cost of the product by way of crossed demand drafts favoring AHShaikh.com payable at Mumbai.
 
The company under no circumstance will accept any payment in cash.
 
The company has not authorized any officials, officer or IBD of the company to receive any amount in cash for and on behalf of the company towards the joining fee or cost of the products or any other payments, as the case may be except appointed Stockists of Membership Card of AHShaikh.com system, ths list of all the stockists is available at Stockist Register. If anybody makes any payment in cash, it will be at his/her own risk and under no circumstances will the company assume any vicarious liability to such acts, or be answerable to such unauthorized cash payments.

The IBD will be eligible for incentive or income only as per the volume of business done by him/her that is also subject to the eligibility norms formulated by the company. The company does not assure any incentive or income to The IBD merely on account of his/her joining the company.
 
The independent IBD will not be consumer, agent or employee of the company in any respect. His/her position being so, he/she cannot bind the company in any manner nor he/she has any authority to bind the company or to represent or speak on behalf of the company. The IBD cannot make any commitment for and on behalf of the company unless an express consent in writing from the company.
 
The company will accept the applicants offer and approves him/her as an IBD by issuing an official receipt and an online registration, which will carry the user name and password as chosen by the applicant himself/herself and an auto generated identification number known as id., This user name and id have to be quoted by the IBD in all his/her transactions and correspondence with the company. The id once generated cannot be altered at any latter point of time.
 
The company will in no case entertain any communication without user id [id] and user name.
 
Trimming, service/handling charges, Taxes, Government/official Bodies Levies, will be deducted as per the company norms or as formulated by the local / central government, from time to time.
 
All individual IBD should adhere to rules and regulation formed by the company and the participating MLM companies and if any of The IBD is found guilty of not observing the same, then he/she will be terminated from the company as well as participating company/companies.
 
The company reserves all rights to terminate a IBD without assigning any reasons whatsoever. Once a IBD is terminated he/she cannot enter any of the company premises/meeting locations and his /her incentives/income will be stopped immediately.
 
The IBD shall have true faith and allegiance to the company and shall uphold the integrity and decorum of the company and shall maintain good relations with other IBD and other clients.
 
The IBD shall always behave and act in a dignified manner benefiting the status of a IBD of a reputed and leading network marketing company of the country.
 
The IBD shall not compel or induce or mislead any person with any false statement/promise to join the company or to purchase any product.
 
The company will not be answerable for any promise, assurance given by any IBD to any person, unless it is in accordance with the approved business plans and terms of company. Hence, the applicant shall go through the web site : www.AHShaikh.com. and the brochures and notices issued by the company. Through this company sources, he/she will fully inform himself/herself on all these matters.
 
The applicant /IBD shall ensure that all the information furnished to the company is correct and properly entered. Any request for correction of information furnished by the IBD as to his/her sponsor or placement details will not be entertained once payment statements are processed.
 
The company reserves the right to reject any IBD/Application at its own discretion without assigning any reason whatsoever.
 
The company reserves the right to modify the terms and conditions, products, brands, plans/schemes, business and policies, by giving notice through its web site: www.ahshaikh.com. and it will be binding on all IBD’s of the company.
 
If any disputes or differences arises between the parties hereto touching the business or interpretation of any terms and conditions or as to the incentives, income, etc. relating to the business of the company the same shall be referred to arbitration and the arbitration shall be governed by the 'Arbitration And Conciliation Act 1996.'
 
The product/starter kits of the participating company will be shipped within 15 working days directly from the participating companies to the IBD. The company will not be resposible for non receipt of the product/starter kits by the IBD.
 
For Delivery, delivery/packing/handling, charges will be charged extra.

(IBD) State, do hereby solemnly affirm and declare as follows:
 
After carefully reading/hearing it read by others, the terms and conditions and the business plans appended along with the application form, brochures, and In the web site www. AHShaikh.com, I hereby agree to the same, and join as an independent IBD of the company on my own accord and free will, to do the business.
 
I will bear true faith and allegiance to the company and shall uphold the integrity and decorum of the company to which I am about to join as an independent IBD.
 
I will bear utmost honesty and uprightness to other IBD’s and the prospective IBD’s and to other clients of the company. I also swear that I will not indulge in any kind of unfair means to promote my business as a IBD.
 
I have fully understood & am convinced of the terms and conditions with the norms of the company.
 
I am made to understand that being a freelance IBD (independent business distributor), I will not be an agent, employee, or consumer of the company. Hence I have no authority to bind the company or to speak on its behalf.
 
I declare that I have not been given any assurance or promise by the company or its senior level IBD s to any Income on account of the initial payment made by me. However I am made to understand that I will be eligible for income/incentives depending upon the volume of business done by me as per terms.
 
Under any circumstances, I fully understand that the value of the packages offered to me will be higher side than the amount paid by me.
 
I will not promote the business of other companies in the office, premises, and meeting hall or wherever the activities of the company take place.
 
I will not misguide or induce any one dishonestly to join the company. I hereby agree and adhere to the terms and conditions stipulate along with the application form and as mentioned above and agree to do the business.
 
I hereby agree to submit all disputes to arbitration as provided in the terms and conditions of the company.
 
The terms and conditions within above mentioned shall be governed in accordance with the law enforced in the territories of India. Disputes if any arises shall be subject to the exclusive jurisdiction of the court of Mumbai.
 
Subject to Force Major Clause:
 
If the performance as specified in this proposal is prevented, restricted, delayed or interfered by reason of:
 
Fire, explosion, cyclone, floods, War, revolution, acts of public enemies, blockage or embargo, Any law, order, proclamation, ordinance, demand or require come up.
 
Elements of any Government or authority or representative of any such Government including restrictive trade practices or regulations;
 
Strikes shutdowns or labour disputes which are not instigated for the purpose of avoiding obligations herein, or;
 
Any other circumstances beyond the control of the party affected.
 
Then notwithstanding anything hereto contained, the party affected shall be excused from its performance to the extent such performance relates to prevention, restriction, delay or interference and provided the party so affected uses its best efforts to remove such cause on non-performance and when removed the party shall continue performance with utmost dispatch.
